Nursing homes are required to consider menu choices carefully, ensuring that the options they offer their residents contain the proper amount of nutrients. Although many guidelines are put in place for how long-term care facilities must provide adequate food and water, malnourishment and lack of proper hydration are prevalent issues in nursing homes.

At The Law Offices of Mark Redmond, we take elder abuse very seriously. Our priority is to defend the rights of nursing home residents who are being mistreated. If you or a family member is in a situation where your nursing home is failing in the area of nutrition and/or hydration, reach out to our Sacramento malnutrition and dehydration attorneys immediately.

A Nursing Home’s Responsibility to Prevent Malnutrition

Since elderly individuals have weaker immune systems, getting the proper amount and type of nutrients is vital to sustaining their health and wellbeing. Unfortunately, many nursing homes are falling short in providing what their residents need.

Studies have shown that about one-third of nursing home residents experience some form of malnourishment. In some long-term care facilities, malnutrition affects up to 85 percent of the residents.

In an effort to prevent malnourishment, nursing homes are required to:

  • Serve at least three meals a day
  • Strive to accommodate food and mealtime preferences
  • Offer snacks prior to bedtime
  • Provide special eating utensils when required
  • Store, prepare, and deliver food in a sanitary manner
  • Post menus for the current and following week
  • Create menus that follow national dietary standards
  • Be sensitive to residents’ food habits and cultural backgrounds
  • Ensure residents have adequate time and assistance to eat
  • Present food attractively and at the proper temperature

If a resident begins to experience complications in eating, the nursing home should establish a plan to allow for the individual to continue to consume food orally. For example, the staff may implement a therapeutic program that helps the resident improve their ability to swallow. If any resident demonstrates any signs of malnourishment, the nursing home must notify the person’s physician right away.

The Problem of Dehydration in Long-Term Care Facilities

Nursing homes are required to provide their residents with sufficient fluids. When residents are not given enough water and other beverages to drink, it can result in dehydration. If someone becomes too dehydrated, it can result in serious illness or even death.

Signs of dehydration include:

  • Dry mouth
  • Increased thirst
  • Confusion
  • Headaches
  • Dizziness
  • Tiredness
  • Fevers
  • Constipation
  • Skin problems
  • Decreases urination
